Dr. Javier Junceda<\/p><\/div>\n

Javier Junceda<\/u><\/strong><\/em><\/a>, renowned jurist, former Dean of the Faculty of Law of the International University of Catalonia<\/strong> and Numerary Member of the Royal European Academy of Doctors<\/strong> (READ), reflects on the common sense of the legislator, the fragility of democracy and the need for the State to uphold democracy against populisms of various kinds in the articles \u201cInfinitas leyes\u201d<\/strong> and \u201cMovilizaciones\u201d<\/strong>, published in the digital newspaper El Debate<\/strong> on 11 and 29 June, respectively. The academic is also featured in a report that the digital newspaper The Objective<\/strong> devoted to the latest session, held on 26 June, of the Hispanic-American Legal Studies Forum<\/strong>, a platform of expert jurists from both sides of the Atlantic promoted by Junceda himself. The session was entitled \u201cIbero-American Constitutional Justice\u201d<\/strong> and featured, among other prominent figures, the Spanish Constitutional Court<\/strong> judge Juan Carlos Campo<\/strong> and the former president of the Constitutional Court<\/strong> of Peru, Ernesto Blume<\/strong>.<\/p>\n

In \u201cInfinitas leyes\u201d<\/strong>, the READ academic urges parliaments to devote themselves to rigorous political oversight of governments and to keeping their laws up to date, rather than promoting countless legislative reforms that only increase an already unmanageable body of regulations. \u201cWhat used to be simple to do by consulting the Mart\u00ednez Alcubilla<\/strong> or Aranzadi<\/strong> collections, where all existing legal resources were compiled, is now unthinkable. The infinity of regulations is not only impossible for any citizen to know; even legal professionals cannot be fully sure of them, given the considerable accumulation of provisions. Under these circumstances, there can be no justification for making someone who is unaware of a law bear its legal consequences, because such a provision no longer corresponds at all to the reality of the present moment, as the Civil Code<\/strong> also requires when applying legal rules\u201d, he points out.<\/p>\n

For his part, in \u201cMovilizaciones\u201d<\/strong>, he questions whether, under the right to freedom of expression, populist movements of various kinds threaten the rule of law through mobilisations whose ultimate objective is to subvert it. \u201cDemocratic strengthening requires reinforcing its institutional framework and limiting these mobilisations to the simple exercise of the right to peaceful and constructive assembly. With scrupulous respect for the established order and for those who have no obligation whatsoever to participate actively in public life, except in elections\u201d, he states.<\/p>\n

Regarding the latest session of the Hispanic-American Legal Studies Forum, its sixth, The Objective<\/strong> reports that the Ibero-American Affairs Committee<\/strong> of the Senate<\/strong> has shown interest in its forums and that Junceda himself will meet with its members in September to draw up lines of collaboration aimed at strengthening the rule of law between Spain and Latin America. During the session, the speakers shared their experiences in their respective courts, analysing tensions between powers, dynamic constitutional interpretation and the challenges posed by concentrations of presidential power that weaken institutional checks and balances. They also emphasised the importance of these bodies in preserving democratic institutionalism, especially in contexts of political crisis.<\/p>\n

\"\"Founder and director of Junceda Abogados<\/strong>, the new academic is a Numerary Member of the Royal Institute of Asturian Studies<\/strong>, where he chairs the Committee on Law, Social and Economic Sciences, and of the Royal Asturian Academy of Jurisprudence<\/strong>. He is also a Corresponding Member of the Royal Academy of Jurisprudence and Legislation of Spain<\/strong> and of the North American Academy of the Spanish Language<\/strong>, and an Honorary Member of the Peruvian Academy of Law<\/strong>. He is a member of the Barcelona Arbitration Court<\/strong>, the Arbitration<\/strong> Court<\/strong> of the European<\/strong> Arbitration<\/strong> Association<\/strong> based in Madrid, and the Arbitration Court<\/strong> of the Pontifical Catholic University of Peru. Since 2016, he has been a member of the Urban Planning and Territorial Planning Committee of the Principality of Asturias<\/strong>, chosen from among experts of recognised prestige, and a member of the Advisory Board<\/strong> of the Spanish Association of Urban Planning Law<\/strong>.<\/p>\n

He has served as an expert on 18 parliamentary committees on legislative reforms and has drafted various bills, legislative proposals, and regulatory provisions. He is the author or co-author of more than two hundred legal works, some of which have served as the basis for various judicial rulings by the Constitutional<\/strong> Court<\/strong> of<\/strong> Chile<\/strong>, the Supreme<\/strong> Court<\/strong> of<\/strong> Peru,<\/strong> and courts in Bolivia. He has received mentions in the Luis Sela Sampil Awards<\/strong> for doctrinal articles from the Faculty of Law of the University of Oviedo<\/strong> and, on two occasions, in the prrsaestigious Financial Studies Award<\/strong> (1992 and 2012), organised by the Centre for Financial Studies<\/strong> in Madrid<\/strong>. He is also a member of 14 editorial boards of Spanish and international legal journals. He has been recognised as a doctor honoris causa by six foreign universities and as an honorary professor by six others. He has served as director, speaker or lecturer in more than fifty training programmes held in Spain and Latin America.<\/p>\n
