M\u00e9ndez, during his presentation at the 10th International Academic Meeting of the RAED<\/p><\/div>\n<p><a href=\"https:\/\/raed.academy\/academicos\/dr-fernando-pedro-mendez-gonzalez\/\"><em><strong><u>Fernando P. M\u00e9ndez<\/u><\/strong><\/em><\/a>, Registrar of Land, Commercial and Movable Property and Numerary Member and member of the <strong>Governing Board<\/strong> of the <strong>Royal European Academy of Doctors<\/strong> (READ), presented the lecture <strong>\u201cRegulatory competence of the European Union in the field of land registers and immovable property rights\u201d<\/strong> at the <strong>10th International Academic Meeting<\/strong> held by the Royal Academy between 15 and 20 March in several German cities under the general title <strong>\u201cThe Rhine as a current of knowledge: cross-border dialogues\u201d<\/strong>. In it, he concludes that Brussels lacks competence to regulate registration procedures, the legal value or the effects of entries in the land registers of the Member States.<\/p>\n<p>The expert began his address by referring to Article 345 of the <strong>Treaty on the Functioning of the European Union<\/strong>, which protects both the substantive content of the right to property and the regime governing the acquisition and transfer of immovable property, including registration systems, whether document-based or rights-based. Land registers are not a mere administrative formality, the speaker argued, but form an inseparable part of the property regime because they determine the enforceability of acts against third parties and the legal certainty of transfers. In systems such as the Spanish one, which is based on the registration of rights, registration confers enhanced protection through the principle of public faith in the register, making it an essential element of the real right itself, he argued.<\/p>\n<p>M\u00e9ndez examined specific examples that illustrate this respect for national competences, such as the 2012 European regulation on <em>mortis causa<\/em> successions, which expressly excludes from its scope entries in registers of rights, their legal requirements and their effects. As regards the project to interconnect European land registers, he pointed out that it is an instrument of cross-border judicial cooperation, based on mutual recognition, but not on harmonisation. Indeed, participation is not compulsory, and some states have declined to join precisely because of the risks of legal confusion generated by direct access to such different systems.<\/p>\n<p>As for the content of the right to property, the Member States retain primary competence, although they must respect the minimum standard established in Article 17 of the <strong>Charter of Fundamental Rights of the European Union<\/strong>, which recognises the right to possess, use, dispose of and bequeath property, subject to the limitations required by the general interest. The Union may intervene in a subsidiary and proportionate manner when necessary to guarantee fundamental freedoms, such as the free movement of capital or freedom of establishment, or the proper functioning of the internal market, but always in compliance with the principles of subsidiarity and proportionality.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-186827\" src=\"https:\/\/raed.academy\/wp-content\/uploads\/2026\/06\/bienes-inmuebles-registro-propiedad-inmobiliaria-bienes-raices-casa-o-edificio-en-alquiler-compra-venta-hogar-hipoteca-shutt-1.67.webp\" sizes=\"(max-width: 600px) 100vw, 600px\" srcset=\"https:\/\/raed.academy\/wp-content\/uploads\/2026\/06\/bienes-inmuebles-registro-propiedad-inmobiliaria-bienes-raices-casa-o-edificio-en-alquiler-compra-venta-hogar-hipoteca-shutt-1.67.webp 600w, https:\/\/raed.academy\/wp-content\/uploads\/2026\/06\/bienes-inmuebles-registro-propiedad-inmobiliaria-bienes-raices-casa-o-edificio-en-alquiler-compra-venta-hogar-hipoteca-shutt-1.67-440x264.webp 440w\" alt=\"\" width=\"600\" height=\"360\" \/>To put an end to any legal confusion, the academic called on the EU authorities to introduce a common definition of property that would serve as a minimum framework, drawing inspiration from instruments such as the <strong>Draft<\/strong> <strong>Common Frame of Reference<\/strong>, without encroaching on state competences. In this regard, the expert underlined the particularly sensitive nature of immovable property, which is linked to territory, housing, and basic resources such as accommodation. In a context of growing concern over access to housing, states are especially protective of their regulatory powers, and the Union must act with caution in the face of public perception of excessive intrusion into national competences.<\/p>\n<p>M\u00e9ndez served as Dean of the <strong>Association of Land, Commercial and Movable Property Registrars of Catalonia<\/strong> between 1993 and 2001, and of the <strong>Association of Land, Commercial and Movable Property Registrars of Spain<\/strong> between 2001 and 2006. He later served as Director of International Relations for the same Association of Registrars from 2013 to 2017. For his professional and academic work, he received the <strong>Grand Cross of San Raimundo de Pe\u00f1afort<\/strong>. In October 1993, together with <strong>Alfonso Hern\u00e1ndez<\/strong>, he published the article <strong>\u201cCost of changing mortgage\u201d<\/strong> in the newspaper <strong>\u201cLa Vanguardia\u201d<\/strong>, which had an unprecedented impact on the Spanish mortgage landscape. In March 1994, the <strong>Cortes<\/strong> unanimously approved the law on subrogation and modification of mortgage loans, taking that article as its basis. He has formed part of expert groups that have prepared various legislative texts, including the 2007 Land Law and Law 4\/2013 on Measures to Make the Housing Rental Market More Flexible and Promote It. He has published five monographs, directed and contributed to various collective works, and published numerous articles.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fernando P.
