M\u00e9ndez, durant la seva intervenci\u00f3 a la X Trobada Acad\u00e8mica Internacional de la RAED<\/p><\/div>\n<p><a href=\"https:\/\/raed.academy\/ca\/academics\/dr-fernando-pedro-mendez-gonzalez\/\" target=\"_blank\" rel=\"noopener\"><em><strong>Fernando P. M\u00e9ndez<\/strong><\/em><\/a>, registrador de la Propietat Mercantil i de B\u00e9ns Mobles i acad\u00e8mic de n\u00famero i membre de la <strong>Junta de Govern<\/strong> de la <strong>Reial Acad\u00e8mia Europea de Doctors<\/strong> (RAED), va presentar a la<strong> X Trobada Acad\u00e8mica Internacional<\/strong> que la Reial Corporaci\u00f3 va celebrar entre els passats 15 i 20 de mar\u00e7 a diverses ciutats alemanyes sota el t\u00edtol gen\u00e8ric <strong>&#8220;El Rin com a corrent del coneixement: di\u00e0legs transfronterers&#8221;<\/strong> la pon\u00e8ncia <strong>&#8220;Compet\u00e8ncia normativa de la Uni\u00f3 Europea a l&#8217;\u00e0mbit dels registres de la propietat i dels drets de propietat immobiliaris&#8221;<\/strong>, en la qual conclou que Brussel\u00b7les manca de compet\u00e8ncia per regular els procediments d&#8217;inscripci\u00f3, el valor jur\u00eddic o els efectes de les inscripcions en els registres de la propietat immobili\u00e0ria dels estats membre.<\/p>\n<p>L&#8217;expert va iniciar la seva intervenci\u00f3 al\u00b7ludint a l&#8217;article 345 del <strong>Tractat de Funcionament de la Uni\u00f3 Europea<\/strong>, que protegeix tant el contingut substancial del dret de propietat com el r\u00e8gim d&#8217;adquisici\u00f3 i transmissi\u00f3 de b\u00e9ns immobles, i inclou els sistemes registrals, siguin de documents o de drets. Els registres immobiliaris no s\u00f3n un simple tr\u00e0mit administratiu, va argumentar el ponent, sin\u00f3 que formen part inseparable del r\u00e8gim de propietat perqu\u00e8 determinen l&#8217;oponibilitat dels actes davant tercers i la seguretat jur\u00eddica de les transmissions. A sistemes com l&#8217;espanyol, basat en el registre de drets, la inscripci\u00f3 genera una protecci\u00f3 refor\u00e7ada a trav\u00e9s de la fe p\u00fablica registral, la qual cosa la converteix en un element essencial del mateix dret real, va argumentar.<\/p>\n<p>M\u00e9ndez va examinar exemples concrets que il\u00b7lustren aquest respecte a les compet\u00e8ncies nacionals, com ara el reglament europeu del 2012 sobre successions mortis causa, que exclou expressament del seu \u00e0mbit les inscripcions en registres de drets, els seus requisits legals i els seus efectes. Pel que fa al projecte d&#8217;interconnexi\u00f3 dels registres de la propietat europeus, va assenyalar que es tracta d&#8217;un instrument de cooperaci\u00f3 judicial transfronterera, basat en el reconeixement mutu, per\u00f2 no d&#8217;harmonitzaci\u00f3. De fet, la participaci\u00f3 no \u00e9s obligat\u00f2ria i alguns estats han declinat sumar-s&#8217;hi precisament pels riscos de confusi\u00f3 jur\u00eddica que genera l&#8217;acc\u00e9s directe a sistemes tan diferents.<\/p>\n<p>Pel que fa al contingut del dret de propietat, els estats membre conserven la compet\u00e8ncia principal, tot i que han de respectar el m\u00ednim establert a l&#8217;article 17 de la<strong> Carta dels Drets Fonamentals de la Uni\u00f3 Europea<\/strong>, que reconeix el dret a posseir, utilitzar, disposar i llegar b\u00e9ns, amb les limitacions pr\u00f2pies de l&#8217;inter\u00e8s general. La Uni\u00f3 pot intervenir de forma subsidi\u00e0ria i proporcional quan sigui necessari per garantir les llibertats fonamentals com la lliure circulaci\u00f3 de capitals o la llibertat d&#8217;establiment, o b\u00e9 el bon funcionament del mercat interior, per\u00f2 sempre respectant els principis de subsidiarietat i proporcionalitat.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-186827\" src=\"https:\/\/raed.academy\/wp-content\/uploads\/2026\/06\/bienes-inmuebles-registro-propiedad-inmobiliaria-bienes-raices-casa-o-edificio-en-alquiler-compra-venta-hogar-hipoteca-shutt-1.67.webp\" sizes=\"(max-width: 600px) 100vw, 600px\" srcset=\"https:\/\/raed.academy\/wp-content\/uploads\/2026\/06\/bienes-inmuebles-registro-propiedad-inmobiliaria-bienes-raices-casa-o-edificio-en-alquiler-compra-venta-hogar-hipoteca-shutt-1.67.webp 600w, https:\/\/raed.academy\/wp-content\/uploads\/2026\/06\/bienes-inmuebles-registro-propiedad-inmobiliaria-bienes-raices-casa-o-edificio-en-alquiler-compra-venta-hogar-hipoteca-shutt-1.67-440x264.webp 440w\" alt=\"\" width=\"600\" height=\"360\" \/>Per acabar amb qualsevol confusi\u00f3 jur\u00eddica, l&#8217;acad\u00e8mic va apel\u00b7lar a les autoritats comunit\u00e0ries a introduir una definici\u00f3 comuna propietat que serveixi com a marc m\u00ednim, inspirant-se en instruments com l&#8217;<strong>Esborrany de Marc Com\u00fa de Refer\u00e8ncia<\/strong>, sense envair les compet\u00e8ncies estatals. L&#8217;expert va subratllar en aquest sentit el car\u00e0cter especialment sensible de la propietat immobili\u00e0ria, vinculada al territori, a l&#8217;habitatge i a recursos b\u00e0sics com l&#8217;allotjament. En un context de preocupaci\u00f3 creixent per l&#8217;acc\u00e9s a l&#8217;habitatge, els estats s\u00f3n particularment gelosos de la seva regulaci\u00f3 i la Uni\u00f3 ha d&#8217;actuar amb prud\u00e8ncia davant la percepci\u00f3 ciutadana d&#8217;una invasi\u00f3 excessiva de compet\u00e8ncies nacionals.<\/p>\n<p>M\u00e9ndez\u00a0va ser deg\u00e0 del\u00a0<strong>Col\u00b7legi Registradors de la Propietat, Mercantiles i B\u00e9ns Mobles de Catalunya<\/strong>\u00a0entre els anys 1993 i el 2001 i del <strong>Col\u00b7legi de Registradors de la Propietat, Mercantiles i B\u00e9ns Mobles d&#8217;Espanya<\/strong> entre el 2001 i el 2006. Posteriorment va assumir el c\u00e0rrec de director de Relacions Internacionals del mateix Col\u00b7legi de Registradors (2013-2017). Per la seva tasca professional i acad\u00e8mica va rebre la <strong>Gran Creu de Sant Raimon de Penyafort<\/strong>. L&#8217;octubre del 1993, juntament amb <strong>Alfonso Hern\u00e1ndez<\/strong>, va publicar al diari <strong>&#8220;La Vanguardia&#8221;<\/strong> l&#8217;article titulat <strong>&#8220;Coste del cambio de hipoteca&#8221;<\/strong>, que va produir un impacte sense precedents en el panorama hipotecari espanyol. El mar\u00e7 del 1994, les <strong>Corts<\/strong> van aprovar, per unanimitat, la llei de Subrogaci\u00f3 i Modificaci\u00f3 de pr\u00e9stecs hipotecaris, prenent com a base l&#8217;esmentat article. Ha format part dels grups d&#8217;experts que han preparat diversos textos normatius, entre d&#8217;altres, els de la llei del S\u00f2l del 2007 i la llei 4\/2013 de Mesures de Flexibilitzaci\u00f3 i Foment del Mercat de Lloguer d&#8217;Habitatges. Ha publicat cinc monografies, dirigit i participat en diverses obres col\u00b7lectives i publicat nombrosos articles.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fernando P.
