M\u00e9ndez<\/p><\/div>\n<p><a href=\"https:\/\/raed.academy\/ca\/academics\/dr-fernando-pedro-mendez-gonzalez\/\" target=\"_blank\" rel=\"noopener\"><em><strong>Fernando P. M\u00e9ndez<\/strong><\/em><\/a>, registrador de la Propietat Mercantil i de B\u00e9ns Mobles i acad\u00e8mic de n\u00famero i membre de la Junta de Govern de la <strong>Reial Acad\u00e8mia Europea de Doctors<\/strong> (RAED), va analitzar el problema actual de l&#8217;habitatge a Espanya i va plantejar algunes vies de resoluci\u00f3 a un col\u00b7loqui celebrat el passat 14 de gener a la <strong>Llibreria Byron<\/strong> de Barcelona per <strong>Societat Civil Catalana<\/strong> en qu\u00e8 tamb\u00e9 va participar la professora de Dret Civil de la <strong>Universitat de Barcelona Chantal Moll<\/strong>. La sessi\u00f3 va ser presentada i moderada per <strong>Ferran Brunet<\/strong>, membre de la <strong>Junta Directiva<\/strong> i responsable de la vocalia d&#8217;Economia i Empresa de l&#8217;entitat organitzadora. Els dos experts van analitzar les claus de la pol\u00edtica d&#8217;habitatge, la falta de terra edificable, els lloguers cada cop m\u00e9s limitats, la burocr\u00e0cia i les regulacions, la complexa i elevada fiscalitat, l&#8217;efecte de la immigraci\u00f3 i la inseguretat de la propietat i l&#8217;ocupaci\u00f3, entre altres aspectes.<\/p>\n<p>M\u00e9ndez i Moll van coincidir que el problema de l&#8217;acc\u00e9s a l&#8217;habitatge no respon a un \u00fanic factor, sin\u00f3 a la combinaci\u00f3 de diversos elements estructurals que afecten tant l&#8217;oferta com la seguretat del mercat immobiliari, destacant que l&#8217;escassetat d&#8217;habitatge disponible \u00e9s una de les causes centrals de l&#8217;encariment dels preus, agreujada per l\u2019exc\u00e9s de regulaci\u00f3 i la inseguretat jur\u00eddica que perceben els propietaris. Aquesta situaci\u00f3, van assenyalar, redueix la inversi\u00f3 i limita l&#8217;oferta, el que contribueix a augmentar el cost del lloguer i dificulta l&#8217;acc\u00e9s a l&#8217;habitatge, especialment per als sectors m\u00e9s vulnerables.<\/p>\n<p>&#8220;L&#8217;escassetat d&#8217;habitatge i els seus elevats preus ens han convertit en una societat d&#8217;inquilins, la qual cosa suposa una bomba de rellotgeria per a les pensions, perqu\u00e8 una persona amb la casa pagada nom\u00e9s destina el 7% de la seva renda a l&#8217;habitatge, en tant que un inquil\u00ed ho fa en un 40%. Qu\u00e8 passar\u00e0 quan aquesta gent es jubili?&#8221;, es va preguntar l&#8217;acad\u00e8mic de la RAED plantejant un problema de fons, que al seu entendre tindr\u00e0 greus repercussions de cara al futur. Aix\u00ed mateix, el ponent va assenyalar que l&#8217;administraci\u00f3 s&#8217;ha transformat en una &#8220;m\u00e0quina d&#8217;impedir&#8221;. En aquest sentit, va referir les dades del <strong>Tribunal de Defensa de la Compet\u00e8ncia<\/strong> que assenyalen com la gesti\u00f3 del s\u00f2l i la lentitud en les llic\u00e8ncies encareixen el preu final de l&#8217;habitatge un 30%.<\/p>\n<p>Davant d&#8217;aquesta situaci\u00f3, M\u00e9ndez va apel\u00b7lar a una important reforma legal i administrativa inspirada en el model alemany, que elimina la llic\u00e8ncia pr\u00e8via. &#8220;El dret a edificar ha de partir de la planificaci\u00f3 urban\u00edstica, que \u00e9s la llei, no de la voluntat d&#8217;un funcionari, com passa ara&#8221;, va considerar. La seva proposta implica substituir el perm\u00eds d&#8217;obra actual per una comunicaci\u00f3 responsable d&#8217;arquitectes i promotors. I si un consistori veu algun indici d&#8217;il\u00b7legalitat, que sigui un jutge qui ho determini i, si \u00e9s el cas, aturi l&#8217;obra. D&#8217;altra banda, l&#8217;acad\u00e8mic va defensar el paper de les socimi (Societats An\u00f2nimes Cotitzades d&#8217;Inversi\u00f3 Immobili\u00e0ria) com a actors clau per millorar el funcionament del mercat del lloguer a Espanya, criticant la seva demonitzaci\u00f3, que va titllar d&#8217;ideol\u00f2gica. Segons va explicar, el 92% del mercat \u00e9s as les mans de petits propietaris, fet que, a parer seu, genera un sistema &#8220;amateur i ineficient&#8221; sense capacitat per reduir preus ni oferir estabilitat.<\/p>\n<p>M\u00e9ndez va argumentar que la pres\u00e8ncia de grans empreses immobili\u00e0ries aportaria professionalitzaci\u00f3 i seguretat als inquilins, ja que, a difer\u00e8ncia dels propietaris particulars, aquestes corporacions no necessiten recuperar l&#8217;habitatge per motius personals i poden garantir contractes estables a llarg termini. Aix\u00ed mateix, va comparar el paper potencial de les socimi amb el de les grans superf\u00edcies comercials, que competeixen entre si ajustant preus i millorant el servei. L&#8217;economista va destacar que la flexibilitzaci\u00f3 normativa d&#8217;aquestes societats el 2012 va afavorir el creixement del mercat del lloguer, amb la incorporaci\u00f3 de 700.000 nous inquilins en quatre anys. Tot i aix\u00f2, va advertir que la llei d&#8217;Habitatge del 2023 est\u00e0 generant inseguretat jur\u00eddica i provocant la retirada d&#8217;inversors en un moment d&#8217;alta demanda.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-133791\" src=\"https:\/\/raed.academy\/wp-content\/uploads\/2023\/05\/Derecho-a-la-propiedad-y-vivienda-Dominio-Publico-DST.webp\" sizes=\"(max-width: 600px) 100vw, 600px\" srcset=\"https:\/\/raed.academy\/wp-content\/uploads\/2023\/05\/Derecho-a-la-propiedad-y-vivienda-Dominio-Publico-DST.webp 600w, https:\/\/raed.academy\/wp-content\/uploads\/2023\/05\/Derecho-a-la-propiedad-y-vivienda-Dominio-Publico-DST-440x264.webp 440w\" alt=\"\" width=\"600\" height=\"360\" \/>Finalment, M\u00e9ndez va criticar la denominada llei Beckham per considerar que afavoreix els compradors estrangers, que tributen a un tipus fix inferior al dels residents espanyols amb alts ingressos. Segons va afirmar, aquest avantatge fiscal augmenta la demanda estrangera i contribueix a l&#8217;encariment de l&#8217;habitatge, per la qual cosa va demanar la seva derogaci\u00f3 en considerar-la contradict\u00f2ria amb les pol\u00edtiques d&#8217;acc\u00e9s a l&#8217;habitatge. Els dos ponents van destacar tamb\u00e9 l&#8217;impacte de factors econ\u00f2mics i demogr\u00e0fics, com la pressi\u00f3 fiscal sobre la propietat i el creixement de la poblaci\u00f3, que incrementen la demanda. Dins d&#8217;aquest context, adverteixen que les pol\u00edtiques p\u00fabliques s&#8217;han de centrar a fomentar la construcci\u00f3, garantir la seguretat jur\u00eddica i crear condicions que afavoreixin l&#8217;equilibri entre propietaris i inquilins.<\/p>\n<p>M\u00e9ndez\u00a0va ser deg\u00e0 del\u00a0<strong>Col\u00b7legi\u00a0Registradors\u00a0de la\u00a0Propietat,\u00a0Mercantiles\u00a0i\u00a0B\u00e9ns\u00a0Mobles\u00a0de\u00a0Catalunya<\/strong>\u00a0entre els anys 1993 i el 2001 i del <strong>Col\u00b7legi de Registradors de la Propietat, Mercantiles i B\u00e9ns Mobles d&#8217;Espanya<\/strong>\u00a0entre el 2001 i el 2006. Posteriorment va assumir el c\u00e0rrec de director de\u00a0Relacions\u00a0Internacionals\u00a0del mateix Col\u00b7legi de Registradors (2013-2017). Per la seva tasca professional i acad\u00e8mica va rebre la <strong>Gran Creu de Sant Raimon de Penyafort<\/strong>. L&#8217;octubre del 1993, juntament amb <strong>Alfonso Hern\u00e1ndez<\/strong>, va publicar al diari <strong>&#8220;La Vanguardia&#8221;<\/strong> l&#8217;article titulat <strong>&#8220;Coste del cambio de hipoteca&#8221;<\/strong>, que va produir un impacte sense precedents en el panorama hipotecari espanyol. El mar\u00e7 del 1994, les <strong>Corts<\/strong> van aprovar, per unanimitat, la llei de Subrogaci\u00f3 i Modificaci\u00f3 de pr\u00e9stecs hipotecaris, prenent com a base l&#8217;esmentat article. Ha format part dels grups d&#8217;experts que han preparat diversos textos normatius, entre d&#8217;altres, els de la llei del S\u00f2l del 2007 i la llei 4\/2013 de Mesures de Flexibilitzaci\u00f3 i Foment del Mercat de Lloguer d&#8217;Habitatges. Ha publicat cinc monografies, dirigit i participat en diverses obres col\u00b7lectives i publicat nombrosos articles.<\/p>\n<p>&nbsp;<\/p>\n<p><iframe loading=\"lazy\" title=\"Chantal Moll y Fernando
